Terms of Service

1. Agreement

By accessing or using KeepStream (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. The Service

KeepStream is a mobile application and web service that allows you to save articles, newsletters, and links, and converts them into audio playlists using AI-powered text-to-speech technology. The Service also provides AI-powered categorization, tagging, summarization, and organization of your saved content.

3. Account

• You must be at least 13 years old to create an account and use the Service.
• You are responsible for maintaining the security of your account credentials.
• You may not create more than one account per person.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Circumvent any usage limits, rate limits, or access controls
• Use automated scripts, bots, or tools to overwhelm the Service with requests
• Attempt to access other users' accounts or data
• Use the Service to store or distribute malware, spam, or harmful content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell, sublicense, or commercially redistribute any part of the Service

5. Content

Your content: You retain ownership of the articles, links, and content you save to KeepStream. By using the Service, you grant KeepStream a limited license to process, store, and convert your content as necessary to provide the Service (including text extraction, AI processing, and TTS generation).

Generated content: AI-generated summaries, categories, tags, and audio files created by the Service from your saved content are provided as part of the Service. KeepStream retains the right to the underlying AI models and technology used to generate this content.

Third-party content: You are responsible for ensuring you have the right to save and process any content you add to KeepStream. We do not verify the copyright status of content you save.

6. Shared Articles

• When you share an article, the article content, AI summary, and audio become publicly viewable via a share link.
• You are responsible for the content you share. Do not share content that is illegal, harmful, or that you do not have the right to distribute.
• You can unshare any article at any time to revoke public access.
• KeepStream reserves the right to remove shared content that violates these Terms or applicable laws, without prior notice.

7. Subscriptions

Free tier:

• Unlimited article saves
• Basic AI summaries
• 5 text-to-speech items per month
• Auto-categorization and tagging

Pro subscription:

• $5.99 per month or $49.99 per year
• Unlimited text-to-speech
• Detailed summaries with key takeaways
• Smart playlists, Stash Brain AI, offline downloads, and all premium features

Billing:

• Subscriptions are billed through Apple App Store or Google Play Store.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
• You can cancel your subscription at any time through your device's subscription settings (Apple Settings or Google Play).
• No refunds are provided for partial billing periods. Contact Apple or Google for refund requests, as they process all payments.

8. Intellectual Property

The KeepStream name, logo, software, design, and all associated intellectual property are owned by EGB Digital. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written consent.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee:

• The accuracy or completeness of AI-generated summaries, categories, or tags
• That AI summaries perfectly represent the source material
• Uninterrupted or error-free operation of the Service
• That the Service will meet your specific requirements

10. Limitation of Liability

To the maximum extent permitted by law, KeepStream and EGB Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service is limited to the amount you paid us in subscription fees during the 12 months preceding the claim.

11. Termination

• We may suspend or terminate your account if you violate these Terms, with or without prior notice.
• You may delete your account at any time through the app settings. Upon deletion, all your data (saved items, audio files, account information) will be permanently removed within 30 days.
• Sections regarding intellectual property, disclaimers, limitation of liability, and governing law survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

13. Changes

We may update these Terms from time to time. If we make material changes, we will notify you via email or through an in-app notification at least 14 days before the changes take effect.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
